This makes me laugh I know your going away I just had to give you a little story about what I deal with.
Here in the wonderful state of Utah I have to pay sales tax on repairs. They told me that the drop of resin that is injected into the windshield has now become part of the car. I guess you would call that a tangible product LOL.
If that's really the case you have the legal right to charge sales tax on each repair either to customer or insurance company. More paper work and filings
but it all washes out in the end.
I'd be talking with my accountant on this one Brian. Legally it may end up with you only paying tax on 25 cents of resin per repair with the rest being charged as labor, which in most states is un-taxable.

Sorry I havn't posted for a while, but I don't have access to a computer very often here in San Jose California.
I would like to comment on this thread because this is a problem that lots of people run into. I know that most cities won't issue permits for you to put a tent up. For some reason if you call the city and ask for one they won't give one. Then when you go set up someone always stops buy sooner or later and gives you a hard time. This is one reason I personaly don't do tents, because I ran into this exact problem.
I called the city up and they said I didn't need a permit and that they didn't even give out permits for my type of business and told me to just set up. After I set up I would get city officials stopping by everyday telling me that I wasn't allowed to do this. I would explain to them what the licensing office would say and they would just tell me that they didn't know what they where talking about and that I had to shut down. The police would even sometimes stop buy just to see what I was doing but never bothered me.
I personaly got sick and tired of all the government BS and I also got sick and tired of the car traffic stopping into my location so iratic. Thats when I decided to go do my cold selling which you have all termed "Coitstering", btw I love that term, but anyway, I don't recommend tent locations because of this kind of problem. By now, you may recognize graybeard as a windy 'ol fart who has a problem staying on the topic at hand. As we travel and stay at R.V. parks around the country for any length of time I always check on local business permits. Some require one, some don't.
In '02, The City of Quartzsite AZ. handed me a citation for $250.00, no permit.
Now then though, this is a meca for R.V.r's in Jan. and Feb.
Huge R.V. show, flea mkt, rock and mineral show. About 100,00.00 or so people in that little desert town for a month or so.
$105.00 tickets for "no parking" zone rather vague are the norm X probably 500 a day at least. That little town in the desert does well.
We got into town about 4:30 on a Fri., went to City Hall, closed. Notice said city officials would be at the big tent Sat. from 9:00 -1:00 to issue permits, not so, looked. searched, asked. No one could locate them.
2:00 I just parked my car a few feet inside city limits with sign, several customers before the nice policeman showed up.
By the way, it also cost $80.00 for a permit to do business on B.L.M. property. I had to drive to Yuma, 60 miles south to get that. The govt. also wants a cut of the business you do out there. Also enormous fine if the rangers catch you, and they do, even though it is about 10,000,000 acres of sand. 8)
I'm glad to hear that you stood your ground and prevailed. Yesterday, I called my local Community Development Department to get information on our local laws regarding tents.... They told me that they issue permits for $75 and the permit only lasts 14 consecutive days. Additionally, you cannot re-apply for a new permit for the same location for 180-days (6-months). I'm not very happy about that information; I expect that I will have to make some time to go visit with somebody at the Planning & Zoning office to see if I get the same story from them.

I too am in San Antonio, I have also had a run with the code compliance.
It is my understanding that we sell service but are still required to have a vendor's permit, along with a signed notorized affidavit from the owner of the property.
I am constantly hassled and have been issued a ticket that I have never received in the mail. This was 3 months ago. So now I just try and talk my way out of it by telling the code complianc guys I will leave.
