never mind its gone..just read an article in entrepreneur mag about it and after i posted url i went to make sure it was okay and it was gone..basically saying they wont hold up in court

As a general rule they won't hold up. The problem is the company you sign one with usually has more money than you and can drag it through court. I don't have personal experience with this, but i have seen PDR guys spend a lot of money fighting non-competes.

All my tech's have to sign one as well as a franchise agreement... I figure I will have a vioation at some point and will put about $5,000 into legal fees... as will they... not enough to win, but enough to keep future violators honest.

As I was told by an attorney.
Non-competes as we would be familiar with are designed to stop a person from being hired and trained with another companies time and money and just turning around and using it against them.
There does come a time when the trade becomes a persons profession and considered their means of living. That is the time that the non-compete will not hold water in court. When it changes from one to the other is what is up for interpretation and can only be answered by a judge or mediation board.

I think it may be used as a scare tatic so you won't become another competitor.
